A Mossville man faces up to 25 years in prison for sexually assaulting a woman after forcing her into her car and driving off nearly two years ago.
Gary W. Miller Jr., 27, of 10419 W. Moss St., pleaded guilty Monday to one count of aggravated criminal sexual assault as part of a deal with prosecutors that saw other charges of aggravated vehicular hijacking, vehicular hijacking and criminal sexual assault dropped.
Without the plea, Miller would have gone to trial and forced the victim to testify at his trial. Miller remains in custody pending his June 10 sentencing hearing.
The case has been held up for months as Miller has had mental health issues which have rendered him unfit to stand trial at times.
Prosecutors said during the hearing the woman was putting groceries in her car about 10:30 p.m. June 1, 2008, at Kroger in Chillicothe when Miller approached her, pushed her into her car, took the keys and drove off. Her infant child was in the back seat.
While driving, Miller performed a sex act on her. Fearing for her safety, she told Miller to take her someplace so they wouldn’t be driving. They drove to another parking lot, and Miller got out of the car. The woman then locked the doors and drove off, the prosecutor said. The child was not injured.
